Terms and Conditions ("Terms")

Please read these Terms and Conditions ("Terms", "Terms and Conditions") carefully before purchasing an order from the https://eversports.es/s/Bodyworxhub website operated by Eversports GMBH.

 

Your access to and use of the Service is conditioned on your acceptance of and compliance with these Terms. These Terms apply to all visitors, users and others who access or use the Service.

 

By accessing or using the Service you agree to be bound by these Terms. If you disagree with any part of the terms then you may not access the Service.

 

 

Purchases

If you wish to purchase any product or service made available by BodyWorxHub through Eversports, you may be asked to supply certain information relevant to your Purchase including, without limitation, your Billing and Shipping Address, ID number and email.

 

 

 

IMPORTANT- Outdoor / Online training class rules

1. Class Cancellation time on Eversports app: 2 hours before the session

2. Late Cancellation and Non-Show fee: 1 class will be removed from your pass

3. Minimum participant number per session: 3 (in case this number isn’t reached 2 hours before, the session will be cancelled)

In case the class has been cancelled the class won’t be charged and will be booked back to your pass on the Eversports app.

 

Outdoor classes- Image Rights

1.During our Outdoor classes, BodyWorxHub Trainers may film sequences for marketing purposes on our social media platforms Instagram and Facebook. By attending any of our outdoor classes, you agree with BodyWorxHub sharing images of the training including its participants on our social media platforms.

 

 

Recordings of online classes
BodyWorxHub remains the right to record its online training sessions. During the recording BodyWorxHub uses the Pin function on Zoom to ensure the recorded screen is the trainer's screen only and participants will not be visible.

By attending our online sessions, you accept BodyWorxHub to record Online sessions.

 

Copyright
You will not (and will not allow any third party to) attempt to copy, record or share any Training Recordings or Documentation supplied by BodyWorxHub. BodyWorxHub reserves the right of final decisions in case of any disputes

 

 

 

Memberships 

1.The membership will start by the day of purchase. The amount of the first month varies according to the remaining days of the month. The full monthly fee will be charged starting month two of your membership.

2.All membership fees are withdrawn from your bank account on the first day of the month. In order to process the payment, you need to store a valid credit card on your profile in the Eversports app.

3.Expiry Date for Packs:

Pack of 10 Sessions: this ticket has an expiring date of 3 month

4.Used tickets cannot be exchanged either refunded

5.  Individual class Tickets are non-transferable

6. Individual class Tickets cannot be shared

7. BodyWorxHub reserves the right of final decisions in case of any disputes

BodyWorxHub has no control over, and assumes no responsibility for, the content, privacy policies, or practices of any third party web sites or services. You further acknowledge and agree that BodyWorxHub shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with use of or reliance on any such content, goods or services available on or through any such web sites or services.

 

 

Changes

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material we will try to provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.

Limitations of liability

In no event shall BodyWorxHub  owners, trainers, independent contractors, affiliates be liable to you for any direct, indirect, incidental, special, punitive, or consequential damages whatsoever resulting from any:

Errors, mistakes, or inaccuracies of content

 

Furthermore, all applicants release BodyWorxHub , its owners, trainers, independent contractors, affiliates of all liability regarding 1) any injury to self 2) any loss or damage to personal property during any of the activities
